1. Platform Role
Movygo Inc. ("Movygo") operates a technology marketplace that connects customers with independent drivers who provide delivery, marketplace pickup, and moving-related transportation services across supported Canadian service areas. Movygo is not a carrier, freight forwarder, insurer, warehouse operator, employer, or bailee unless expressly stated in a separate written agreement.
Movygo does not take possession, custody, or control of customer property and does not physically transport items. Transportation services are performed independently by third-party drivers using their own vehicles and equipment. Customers use the platform and arrange transportation services at their own risk to the maximum extent permitted by law.
By creating an account, placing an order, checking an acceptance box, clicking to continue, or otherwise using the platform, you legally accept these Terms and all referenced policies to the maximum extent permitted by law.
2. Supplemental Policies and Service-Specific Rules
Additional policies, pricing notices, city launch rules, service-area restrictions, marketplace rules, pay-on-behalf rules, cancellation policies, safety policies, and feature-specific requirements may apply to particular services or orders. Those supplemental terms form part of these Customer Terms and control where they specifically address the applicable service.
3. Eligibility and Accounts
- You must be at least 18 years old and capable of forming a binding agreement.
- You must provide accurate account, contact, and payment information and keep it current.
- You are responsible for activity on your account and for protecting login credentials.
- Movygo may suspend or close accounts for fraud, chargebacks, abuse, unlawful use, harassment, or security concerns.
4. Customer Responsibilities
- Provide accurate pickup and drop-off details.
- Accurately describe item type, quantity, dimensions, approximate weight, fragility, and access needs.
- Ensure the item is lawful, ready for pickup, and properly packaged.
- Represent that you own the item being transported or are otherwise authorized to arrange its transport.
- Ensure someone authorized is present at pickup and drop-off.
- For marketplace orders, verify seller legitimacy and item authenticity yourself.
- Do not assume passenger transport is included with a Movygo order.
5. No Passenger Transport Included
Movygo is a delivery, moving, and marketplace transport platform, not a passenger transportation service. Customers may not assume that riding in a driver vehicle is included with any order.
Drivers are never required to allow any passenger. If a driver independently chooses to allow a passenger, that decision is made solely between the driver and customer, outside Movygo's service scope, subject to law, safety conditions, and insurance. Movygo does not arrange, supervise, insure, or assume liability for passenger transport.
6. Prohibited and Restricted Items
You may not use Movygo for prohibited items. See the Prohibited Items & Safety Policy. Drivers may refuse any item that is illegal, hazardous, unsafe, misdescribed, or outside vehicle capacity.
7. Pricing, Pre-Authorization, and Final Charges
Prices shown before booking are estimates unless expressly stated as fixed. Final charges may change based on actual route, waiting time, extra stops, helper time, stairs, long carry, or other selected or applied services.
By placing an order, you authorize Movygo and its payment processor to place a temporary authorization hold on your payment method for the estimated price plus a reasonable buffer and to charge the final amount, including taxes, tips, cancellation fees, waiting charges, and route adjustments.
Submission of an order does not guarantee driver acceptance, assignment, pickup, or completion.
8. Waiting Time, No-Show, Failed Pickup, and Cancellations
- Waiting time begins when the driver marks arrival.
- Free waiting periods may apply depending on service type.
- If no one shows up within 5 minutes after arrival at pickup, the driver may cancel as a customer no-show and cancellation fees may be charged.
- If the item is unavailable, release is refused, the listing is fraudulent, or the order cannot be completed due to customer-side issues, one-way compensation and other applicable fees may still be charged.

9. Cargo, Packaging, and Risk Allocation
You are responsible for packaging items securely and disclosing fragile, valuable, or unusual items before pickup. Unless Movygo expressly offers separate declared value coverage in writing, Movygo does not provide cargo insurance. Transport is arranged at your risk to the fullest extent permitted by law.
Customers are encouraged to photograph valuable, fragile, antique, collectible, electronic, or high-value items before pickup.
Drivers are not responsible for damage caused by inadequate packaging, pre-existing item defects, improper assembly, normal movement during transportation, or concealed structural weaknesses. Customers remain responsible for ensuring items are properly packed, protected, and suitable for transport.
Customers acknowledge that pickup photos, delivery photos, timestamps, GPS records, route records, communications records, signatures, customer acknowledgements, and other operational evidence may be relied upon by Movygo and drivers when reviewing disputes, claims, refunds, chargebacks, allegations of non-delivery, allegations of damage, determining service completion, and assessing item condition.
10. Delivery Verification, Photos, and Communications
Users authorize Movygo and drivers to collect and use proof-of-pickup photos, proof-of-delivery photos, timestamps, GPS records, route data, and communications records for operational, fraud prevention, safety, dispute resolution, and compliance purposes.
You also agree that Movygo may contact you by push notification, email, phone call, or text message for order operations, security verification, account protection, delivery coordination, claims handling, support, and legal or compliance notices.
11. Undeliverable, Refused, or Abandoned Items
If delivery cannot be completed and the recipient cannot be contacted, refuses delivery, or is unavailable, the driver may return the item, store the item temporarily, or follow Movygo instructions where no safe and lawful completion option exists.
Additional charges may apply, including return-trip, waiting, storage, handling, or other operational fees where permitted by law and disclosed by the platform or policy.
12. User Content, Uploads, and Evidence Records
If you submit photos, messages, support requests, issue reports, notes, signatures, confirmations, or other content through the platform, you retain ownership of your content but grant Movygo a non-exclusive, worldwide, royalty-free licence to store, reproduce, use, analyze, and disclose that content as reasonably necessary to operate the platform, prevent fraud, resolve disputes, investigate claims, support safety reviews, comply with legal obligations, and improve services.
You represent that you have the right to submit that content and that it does not violate law or third-party rights.
13. Marketplace and Pay-on-Behalf Orders
Movygo does not verify third-party listings, sellers, item authenticity, ownership, or legality. If you ask a driver to pay a seller or inspect a marketplace purchase, you remain fully responsible for the transaction and fraud risk.
14. Fraud, Safety, and Risk Controls
Movygo may require identity verification, delay transactions, place temporary holds, limit account functionality, reject orders, restrict payouts, or suspend accounts where fraud, safety, compliance, payment, chargeback, or platform integrity concerns exist.
Movygo may maintain internal fraud, safety, chargeback, abuse, and compliance records and may use those records when making future account, payout, verification, dispatch, refund, or platform access decisions.
15. Refunds and Chargebacks
Refunds are handled according to the Cancellation & Refund Policy. Improper chargebacks or abuse of credits may lead to account restriction or lawful enforcement measures.
16. Future Services and Platform Changes
Movygo may add, modify, suspend, remove, or discontinue services, pricing models, vehicle categories, platform features, operational requirements, or marketplace functionality at any time without prior notice.
Service availability may vary by city, service area, province, route, driver coverage, launch status, and operational capacity. Some cities may allow drop-off service before pickup service launches, and some areas may be paused or waitlist-only.
Any future insurance, protection plans, declared value programs, or coverage options shall be governed exclusively by the terms applicable to those programs when offered.
17. No Warranty and Service Availability
Movygo services, platform features, dispatch systems, tracking tools, communications, marketplace functionality, and city availability are provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Movygo makes no representations or warranties regarding:
- driver availability
- delivery times
- successful order completion
- uninterrupted platform access
- item condition during transport
- marketplace seller legitimacy
- item authenticity
- route accuracy
- platform availability
- network uptime, GPS precision, device compatibility, or notification delivery
Movygo disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Movygo does not guarantee protection against theft, loss, damage, delay, fraud, seller misconduct, driver misconduct, or other third-party acts.
18. Force Majeure
Movygo shall not be liable for delays, interruptions, cancellations, failures, or inability to perform caused by events beyond its reasonable control, including severe weather, snowstorms, floods, fires, road closures, vehicle breakdowns, internet or telecommunications outages, power failures, labour disruptions, government actions, public emergencies, natural disasters, acts of God, and security incidents.
During such events, services may be delayed, suspended, modified, restricted, or cancelled without liability.
19. Limitation of Liability
To the maximum extent permitted by law, Movygo is not liable for indirect, incidental, special, consequential, or punitive damages, or for cargo value, theft, fraud, delay, driver conduct, passenger transport decisions made independently by drivers, or third-party acts. Movygo's aggregate liability relating to a specific order is limited to the lesser of CAD 50 or the platform service fee retained by Movygo for that order, except where liability cannot legally be excluded.
20. Indemnity, Governing Law, and General Terms
You agree to indemnify and hold harmless Movygo from claims arising from your breach of these terms, your items, your marketplace transactions, your unlawful use of the services, or your negligence or misconduct.
These terms are governed by the laws of Manitoba and the federal laws of Canada applicable there, except to the extent mandatory consumer protection law in your province or territory of residence applies and cannot be excluded. Subject to mandatory law, disputes shall be brought in Manitoba after a good-faith effort to resolve the matter through support first.
You may not assign these terms without Movygo's written consent. Movygo may assign these terms in connection with an affiliate transfer, merger, financing, acquisition, or sale of assets. If any provision is unenforceable, the remaining provisions continue to apply. No waiver is effective unless made in writing by Movygo.
Closing an account does not eliminate outstanding balances, investigations, chargebacks, legal obligations, or liabilities arising before account closure.

21. Consent, Policy Acceptance, and Audit Trail
When you create an account, place an order, or otherwise accept these Terms or any updated policy, Movygo records the date, time, IP address, device information, and approximate location associated with your acceptance to the extent technically available. This audit trail serves as evidence of your consent and the version of the Terms or policy you accepted at that time.
If Movygo updates these Terms or any referenced policy, your continued use of the platform after the effective date constitutes acceptance of the updated version. Where required by law, Movygo will obtain your explicit re-acceptance through the app or website before the update takes effect for your account.
Movygo retains consent records for legal, compliance, audit, and dispute-resolution purposes for at least the duration of your account plus any applicable legal retention period.
