Movygo Customer Terms of Service

1. Platform Role

Movygo operates a technology marketplace that connects customers with independent drivers who provide delivery and transportation services. Movygo is not a carrier, freight forwarder, insurer, warehouse operator, employer, or bailee unless expressly stated in a separate written agreement.

Movygo does not take possession, custody, or control of customer property and does not physically transport items. Transportation services are performed independently by third-party drivers using their own vehicles and equipment. Customers use the platform and arrange transportation services at their own risk to the maximum extent permitted by law.

You may not use Movygo for prohibited items. See the Prohibited Items & Safety Policy. Drivers may refuse any item that is illegal, hazardous, unsafe, misdescribed, or outside vehicle capacity.

5. Pricing, Pre-Authorization, and Final Charges

Prices shown before booking are estimates unless expressly stated as fixed. Final charges may change based on actual route, waiting time, extra stops, helper time, stairs, long carry, or other selected or applied services.

By placing an order, you authorize Movygo and its payment processor to place a temporary authorization hold on your payment method for the estimated price plus a reasonable buffer and to charge the final amount, including taxes, tips, cancellation fees, waiting charges, and route adjustments.

7. Cargo, Packaging, and Risk Allocation

You are responsible for packaging items securely and disclosing fragile, valuable, or unusual items before pickup. Unless Movygo expressly offers separate declared value coverage in writing, Movygo does not provide cargo insurance. Transport is arranged at your risk to the fullest extent permitted by law.

Drivers are not responsible for damage caused by inadequate packaging, pre-existing item defects, improper assembly, normal movement during transportation, or concealed structural weaknesses. Customers remain responsible for ensuring items are properly packed, protected, and suitable for transport.

8. Delivery Verification, Photos, and Communications

Users authorize Movygo and drivers to collect and use proof-of-pickup photos, proof-of-delivery photos, timestamps, GPS records, route data, and communications records for operational, fraud prevention, safety, dispute resolution, and compliance purposes.

9. Marketplace and Pay-on-Behalf Orders

Movygo does not verify third-party listings, sellers, item authenticity, ownership, or legality. If you ask a driver to pay a seller or inspect a marketplace purchase, you remain fully responsible for the transaction and fraud risk.

10. Fraud, Safety, and Risk Controls

Movygo may require identity verification, delay transactions, place temporary holds, limit account functionality, reject orders, restrict payouts, or suspend accounts where fraud, safety, compliance, payment, chargeback, or platform integrity concerns exist.

11. Refunds and Chargebacks

Refunds are handled according to the Cancellation & Refund Policy. Improper chargebacks or abuse of credits may lead to account restriction or lawful enforcement measures.

12. Future Services and Platform Changes

Movygo may add, modify, suspend, remove, or discontinue services, pricing models, vehicle categories, platform features, operational requirements, or marketplace functionality at any time without prior notice.

13. No Warranty and Service Availability

Movygo services, platform features, dispatch systems, tracking tools, communications, and marketplace functionality are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Movygo makes no representations or warranties regarding:

Movygo disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

14. Force Majeure

Movygo shall not be liable for delays, interruptions, cancellations, failures, or inability to perform caused by events beyond its reasonable control, including severe weather, snowstorms, floods, fires, road closures, vehicle breakdowns, internet or telecommunications outages, power failures, labour disruptions, government actions, public emergencies, natural disasters, acts of God, and security incidents.

During such events, services may be delayed, suspended, modified, restricted, or cancelled without liability.

15. Limitation of Liability

To the maximum extent permitted by law, Movygo is not liable for indirect, incidental, special, consequential, or punitive damages, or for cargo value, theft, fraud, delay, driver conduct, or third-party acts. Movygo's aggregate liability relating to a specific order is limited to the lesser of CAD 50 or the platform service fee retained by Movygo for that order, except where liability cannot legally be excluded.

16. Indemnity and Governing Law

You agree to indemnify and hold harmless Movygo from claims arising from your breach of these terms, your items, your marketplace transactions, your unlawful use of the services, or your negligence or misconduct.

These terms are governed by Manitoba law and the federal laws of Canada applicable there. Subject to mandatory law, disputes shall be brought in Manitoba after a good-faith effort to resolve the matter through support first.
