1. Agreement Scope
These Driver Terms govern your use of the Movygo Driver app, website tools, dispatch services, payments, messaging, and support services across supported Canadian service areas (collectively, the "Platform"). By registering, accessing, or using the Platform, you agree to these Terms and all referenced policies.
Electronic acceptance of these Terms, policies, disclosures, or in-app acknowledgements is legally binding to the same extent as acceptance in writing, to the maximum extent permitted by law.
2. Independent Contractor Relationship
Drivers are independent contractors, not employees, partners, agents, or franchisees of Movygo Inc. You decide when to go online, which orders to accept, and how to organize your work, subject to law, safety requirements, and Platform policies.
3. Eligibility, Documents, and Ongoing Compliance
- Maintain a valid driver licence, vehicle registration, and insurance required by law.
- Provide accurate onboarding and profile information and keep it current.
- Upload valid compliance documents for each active vehicle and each added vehicle.
- Ensure vehicles are roadworthy, lawful, and suitable for accepted jobs.
- Do not share your account, identity, or login credentials with any other person.
Drivers are solely responsible for maintaining all legally required insurance coverage. Movygo may collect proof of insurance for compliance purposes but does not guarantee the validity, adequacy, scope, or continuous availability of any driver's insurance coverage.
Drivers are solely responsible for ensuring that their insurance coverage permits the services they perform and remains valid throughout all periods of platform use. Movygo does not verify coverage directly with insurers on a continuous basis and makes no representation that any driver's insurance is valid, adequate, active, or suitable for a particular service.
Driver Document Declaration and Verification
By submitting any document, information, image, selfie, licence, registration, insurance record, vehicle record, identity record, criminal record, background check, or other compliance material, you represent and warrant that:
- all information provided is accurate, complete, current, and truthful;
- the documents belong to you or the vehicle being registered;
- the documents have not been altered, edited, manipulated, forged, or misrepresented;
- you are legally authorized to provide the documents to Movygo.
You acknowledge that Movygo generally verifies information only against the documents and information provided by you and does not have direct access to government databases, licensing authorities, insurance company records, motor vehicle registries, or other official verification systems unless specifically stated otherwise.
Approval by Movygo does not constitute a guarantee, certification, or independent verification of the authenticity, legality, validity, or current status of any submitted document.
Movygo reserves the right, at any time and without notice, to request additional information, reject documents, suspend approval, deactivate accounts, or require re-verification.
Movygo may reject, suspend, deactivate, or require re-verification where a document appears altered, forged, manipulated, inconsistent, incomplete, expired, fraudulent, or otherwise unreliable. Movygo may preserve records and cooperate with law enforcement, regulators, insurers, licensing authorities, or other relevant agencies where fraud is suspected.
Any background check, document review, identity verification, or compliance review is limited in scope and should not be interpreted as a guarantee of safety, future conduct, legal compliance, driving ability, insurance coverage, or suitability for any particular service.
4. Dispatch, Service Areas, and Platform Controls
Movygo may use ETA, location, service area, launch status, document status, acceptance/completion metrics, customer reliability, safety events, and quality ratings for dispatch ranking and offer visibility. Dispatch logic may change over time for marketplace health, safety, fraud prevention, and operational reliability.
Submission of an order by a customer does not guarantee driver acceptance, assignment, pickup, or completion.
5. Service Standards
- Arrive on time and update order statuses accurately in app.
- Transport items safely and lawfully, following all traffic and safety laws.
- Treat customers respectfully; harassment, threats, discrimination, and abuse are prohibited.
- Do not tamper with, misuse, or keep customer property.
- Use proof-of-pickup, proof-of-delivery, GPS, and timeline tools honestly.
- Drivers must take clear and accurate pickup photos before transport begins. Pickup photos should reasonably show the visible condition of the item and any existing damage, defects, packaging issues, or other notable conditions.
- Drivers must take delivery photos showing the item at the delivery location before completing the order. Delivery photos should reasonably show the item's condition upon completion and support delivery verification.
- Failure to capture required photos may affect dispute reviews, claims decisions, account standing, payout eligibility, or platform compliance status.
6. Passenger Transport Is Not a Movygo Service
Movygo does not offer passenger transportation through the driver platform. Drivers are never required to allow a customer or other passenger to ride in the vehicle.
If a driver independently allows a passenger, that decision is made solely by the driver and customer, outside Movygo's service scope, subject to law, insurance, and safety conditions. Movygo does not arrange, supervise, insure, or assume liability for passenger transport.
7. Helpers, Additional Labour, and Equipment
If helpers are used, they are engaged by you, not Movygo. You are responsible for helper conduct, compensation, legal eligibility, safety, and any equipment used to complete jobs.
Drivers retain the right to determine whether an item can be safely loaded, secured, transported, unloaded, or handled using the selected vehicle, equipment, and labour resources. Drivers may refuse service where they reasonably believe the job presents a safety risk.
8. Payments, Payouts, Fees, and Taxes
- Driver earnings can include base fare, distance/time components, stops, stairs, helper charges, and tips.
- Movygo may deduct platform fees, instant payout fees, and other disclosed charges.
- Weekly payout scheduling, reserve/holdback, and instant payout rules are defined in payout settings and policies.
- Drivers are responsible for tax filings and business expenses. Annual tax statements may be generated from payout records.
Earnings estimates, offers, incentives, promotions, and projected payouts are estimates only and may be adjusted based on actual order completion, cancellations, fraud reviews, pricing corrections, customer refunds, chargebacks, or platform error corrections.
9. Confidentiality, Data Use, and Non-Solicitation
- Customer contact details and order data may only be used to complete Platform orders.
- Do not copy customer lists, scrape marketplace data, or use Platform data for unrelated business purposes.
- Do not pressure customers to transact off-platform to avoid fees.
10. Prohibited Conduct
- Fraud, collusion, fake orders, GPS spoofing, duplicate accounts, or false status updates.
- Theft, cargo tampering, intentional damage, or transporting prohibited or unsafe items.
- Impersonation, identity misuse, unauthorized account sharing, or security bypass attempts.
11. Platform Evidence and Communications
Drivers authorize Movygo to collect, store, and use location records, route events, timestamps, pickup and delivery photos, support messages, payout records, and other operational evidence to validate trips, investigate incidents, resolve claims, support compliance review, and prevent fraud.
Drivers also agree that Movygo may contact them by push notification, email, phone call, or text message for dispatch, security verification, payout operations, compliance, support, and legal or operational notices.
12. Fraud, Safety, and Risk Controls
Movygo may require identity verification, delay transactions, place temporary holds, limit account functionality, reject orders, restrict payouts, or suspend accounts where fraud, safety, compliance, payment, chargeback, or platform integrity concerns exist.
Movygo may maintain internal fraud, safety, chargeback, abuse, and compliance records and may use those records when making future account, payout, verification, dispatch, or platform access decisions.
If Movygo reasonably suspects that any document, image, record, or identity information has been altered, forged, manipulated, misrepresented, or obtained unlawfully, Movygo may reject the submission, suspend or deactivate the account, withhold payouts where permitted by law, preserve evidence, and cooperate with law enforcement, regulators, insurers, licensing authorities, or other relevant agencies.
13. Suspension and Deactivation
Movygo may restrict, suspend, or deactivate access for expired documents, repeated no-shows, severe low-quality service, fraud indicators, violence, threats, legal non-compliance, or any serious safety or policy breach. In high-risk events, immediate suspension may be applied pending review.
Closing an account does not eliminate outstanding balances, investigations, chargebacks, legal obligations, payout reviews, or liabilities arising before account closure.
14. No Warranty and Service Availability
Movygo's platform, dispatch tools, messaging tools, payout systems, tracking tools, and supported city availability are provided on an "as is" and "as available" basis. Movygo does not guarantee uninterrupted platform access, route precision, network uptime, GPS accuracy, notification delivery, demand volume, or earnings opportunity in any city or service area.
15. Force Majeure
Movygo shall not be liable for delays, interruptions, cancellations, failures, or inability to perform caused by events beyond its reasonable control, including severe weather, snowstorms, floods, fires, road closures, vehicle breakdowns, internet or telecommunications outages, power failures, labour disruptions, government actions, public emergencies, natural disasters, acts of God, and security incidents.
During such events, services may be delayed, suspended, modified, restricted, or cancelled without liability.
16. Claims, Liability, and Indemnity
To the maximum extent permitted by law, Movygo is not liable for indirect or consequential losses, lost profits, vehicle operating costs, helper disputes, taxes, passenger transport decisions made independently by drivers, or third-party claims arising from driver operations. You agree to indemnify and defend Movygo from claims caused by your acts, omissions, helper conduct, vehicle operations, or breach of these Terms.
17. Dispute Resolution, Governing Law, and General Terms
Before formal proceedings, parties will attempt good-faith resolution through support and documented escalation. These Terms are governed by Manitoba law and applicable federal Canadian law, except to the extent mandatory law in your province or territory applies and cannot be excluded.
You may not assign these terms without Movygo's written consent. Movygo may assign these terms in connection with an affiliate transfer, merger, financing, acquisition, or sale of assets. If any provision is unenforceable, the remaining provisions continue to apply. No waiver is effective unless made in writing by Movygo.

18. Consent, Policy Acceptance, and Audit Trail
When you register as a driver, submit onboarding documents, or accept these Terms or any updated policy, Movygo records the date, time, IP address, device information, and approximate location associated with your acceptance to the extent technically available. This audit trail serves as evidence of your consent and the version of the Terms or policy you accepted at that time.
If Movygo updates these Terms or any referenced policy, your continued use of the platform after the effective date constitutes acceptance of the updated version. Where required by law, Movygo will obtain your explicit re-acceptance through the app or website before the update takes effect for your account.
Movygo retains consent records for legal, compliance, audit, and dispute-resolution purposes for at least the duration of your account plus any applicable legal retention period.
