Movygo Driver Terms of Service

1. Agreement Scope

These Driver Terms govern your use of the Movygo driver app, website tools, dispatch services, payments, messaging, and support services (collectively, the "Platform"). By registering, accessing, or using the Platform, you agree to these Terms and all referenced policies.

2. Independent Contractor Relationship

Drivers are independent contractors, not employees, partners, agents, or franchisees of Movygo. You decide when to go online, which orders to accept, and how to organize your work, subject to law, safety requirements, and Platform policies.

3. Eligibility, Documents, and Ongoing Compliance

Drivers are solely responsible for maintaining all legally required insurance coverage. Movygo may collect proof of insurance for compliance purposes but does not guarantee the validity, adequacy, scope, or continuous availability of any driver's insurance coverage.

4. Dispatch and Marketplace Ranking

Movygo may use ETA, location, service area, document status, acceptance/completion metrics, customer reliability, safety events, and quality ratings for dispatch ranking and offer visibility. Dispatch logic may change over time for marketplace health and safety.

6. Helpers, Additional Labour, and Equipment

If helpers are used, they are engaged by you, not Movygo. You are responsible for helper conduct, compensation, legal eligibility, safety, and any equipment used to complete jobs.

10. Fraud, Safety, and Risk Controls

Movygo may require identity verification, delay transactions, place temporary holds, limit account functionality, reject orders, restrict payouts, or suspend accounts where fraud, safety, compliance, payment, chargeback, or platform integrity concerns exist.

11. Suspension and Deactivation

Movygo may restrict, suspend, or deactivate access for expired documents, repeated no-shows, severe low-quality service, fraud indicators, violence, threats, legal non-compliance, or any serious safety/policy breach. In high-risk events, immediate suspension may be applied pending review.

12. Force Majeure

Movygo shall not be liable for delays, interruptions, cancellations, failures, or inability to perform caused by events beyond its reasonable control, including severe weather, snowstorms, floods, fires, road closures, vehicle breakdowns, internet or telecommunications outages, power failures, labour disruptions, government actions, public emergencies, natural disasters, acts of God, and security incidents.

During such events, services may be delayed, suspended, modified, restricted, or cancelled without liability.

13. Claims, Liability, and Indemnity

To the maximum extent permitted by law, Movygo is not liable for indirect or consequential losses, lost profits, vehicle operating costs, helper disputes, taxes, or third-party claims arising from driver operations. You agree to indemnify and defend Movygo from claims caused by your acts, omissions, helper conduct, vehicle operations, or breach of these Terms.

14. Dispute Resolution and Governing Law

Before formal proceedings, parties will attempt good-faith resolution through support and documented escalation. These Terms are governed by Manitoba law and applicable federal Canadian law.
